Welcome to Florista Pearl Store. By accessing our website, placing an order, or purchasing from us, you agree to the following Terms of Service. Please read these terms carefully before completing your purchase.
1. Our Products
Florista Pearl Store specializes in exporting live rare variegated plants from Thailand. Because our products are living plants, each plant is naturally unique. Size, leaf count, root condition, coloration, and variegation pattern may vary from photos shown on our website or social media.
Product photos are provided as a reference unless clearly stated that the exact plant will be shipped.
2. Order Acceptance
All orders are subject to availability and confirmation. We reserve the right to refuse, cancel, or adjust any order due to inventory changes, pricing errors, export restrictions, suspected fraud, or legal requirements.
An order is considered confirmed only after payment has been successfully received.
3. Pricing & Payment
All prices are listed in U.S. Dollars (USD), unless otherwise stated. Prices may change without prior notice before payment is completed.
We accept payment methods shown on our website or confirmed directly by our team, including PayPal and bank transfer where applicable. Payment must be completed before export preparation begins.
4. Export & International Shipping
All shipments originate from Thailand. International plant export requires preparation, inspection, export documents, phytosanitary certification, cargo handling, customs clearance, and local delivery arrangements.
Estimated shipping timelines are provided for reference only and are not guaranteed. Delays may occur due to airline schedules, customs inspection, agricultural inspection, weather, government procedures, holidays, or other circumstances beyond our control.
For U.S. shipments, plants are normally exported from Thailand and routed through Miami for customs clearance and broker processing before being forwarded to the customer by overnight delivery service.
5. Customer Import Responsibility
Customers are responsible for understanding and complying with the import rules and plant regulations of their own country, state, or region.
Any required import permits, local taxes, duties, quarantine requirements, inspection fees, or government charges after arrival are the responsibility of the customer unless clearly stated otherwise in writing.
6. Live Plant Condition Disclaimer
Live plants may experience stress during international transportation. Minor yellowing, leaf damage, dehydration, leaf loss, root stress, or cosmetic imperfections can occur and are considered normal shipping stress.
These conditions do not automatically qualify for a refund, as long as the plant is generally viable and able to recover with proper care.
7. Inspection Upon Delivery
Customers must inspect their shipment immediately upon delivery. If there is any issue, the customer must contact us within 24 hours after delivery.
To support a claim, customers must provide:
- An uninterrupted unboxing video
- Clear photos of the affected plants
- Photos of the box and packaging condition
- A list of affected plants
Claims submitted without sufficient evidence or after 24 hours may not be accepted.
8. Compensation Policy
If a claim is approved, Florista Pearl Store may offer compensation in the form of replacement plants, store credit, partial refund, or another solution agreed upon by both parties.
The compensation method will be determined based on the condition of the plants, the evidence provided, and the circumstances of the shipment.
9. Customs, Inspection & Government Delays
We are not responsible for delays, plant stress, or damage caused by customs inspection, agricultural inspection, government authorities, airport handling, or the opening of boxes by official agencies.
These processes are outside of our control and may occur during international plant importation.
10. Limitation of Liability
Our maximum liability is limited to the amount paid for the affected products. Florista Pearl Store is not responsible for indirect losses, lost profits, resale losses, business interruption, or consequential damages.
11. Force Majeure
Florista Pearl Store is not liable for failure or delay caused by events beyond our reasonable control, including but not limited to airline delays, customs delays, natural disasters, extreme weather, government restrictions, pandemics, labor strikes, war, or transportation disruption.
12. Changes to These Terms
We reserve the right to update or modify these Terms of Service at any time. Updates will be posted on this page. Continued use of our website or services after changes are posted means you accept the updated terms.
